Welcome to Vestigia. By accessing and using this platform, you accept these terms and conditions in their entirety. If you disagree with any of them, please do not use our services.
Acceptance of terms
By registering or using Vestigia, you confirm that you have read, understood, and accepted these terms. We reserve the right to modify them at any time, notifying you through the platform or by email.
Service description
Vestigia is a digital platform that allows users to create public profiles to document and preserve their personal legacy. The service includes creating profiles, publishing content (texts, photographs, and other media), and exploring other users' legacies.
Registration and user account
- You must be at least 16 years old to register on Vestigia.
- You are responsible for maintaining the confidentiality of your access credentials.
- The information provided during registration must be truthful and up to date.
- Each person may have only one account. Duplicate accounts are not permitted.
User content
- You are solely responsible for the content you publish on your legacy profile.
- It is not permitted to publish illegal, defamatory, offensive, discriminatory content or content that violates third-party rights.
- By publishing content, you grant Vestigia a non-exclusive, free, and worldwide license to display such content on the platform for the purpose of providing the service.
- You retain all intellectual property rights over your content.
Intellectual property
The Vestigia brand, its design, logo, source code, and all elements that make up the platform are the property of Vestigia or its licensors. Their reproduction, distribution, or modification without express authorization is prohibited.
Acceptable use
You agree not to use Vestigia to:
- Impersonate another person.
- Carry out fraudulent or illegal activities.
- Introduce viruses, malware, or any type of harmful code.
- Attempt to access other users' accounts without authorization.
- Use the platform for unauthorized commercial purposes.
Managed profiles
Vestigia allows users to create and manage profiles on behalf of other people ("managed profiles"). By using this feature, you accept the following conditions:
- You may only create a managed profile if you have a direct relationship with the person (family member, close friend, legal representative) or if the person has given you their express authorization.
- If the person is alive, you declare that you have their explicit consent to create and maintain their profile on Vestigia.
- If the person has passed away, you declare that you are a family member, close associate, or legal representative acting in good faith to preserve their legacy.
- You are solely responsible for the truthfulness and legality of all content published on a managed profile, including photographs, texts, and any other material.
- Each user may manage a maximum of 15 managed profiles.
- The represented person (if alive) or their heirs may request the claim or removal of the profile at any time.
Vestigia reserves the right to remove any managed profile that violates these terms or the rights of the represented person.
Image rights
In accordance with applicable image rights legislation:
- By uploading photographs or images to your profile or a managed profile, you declare that you have authorization to use such images or that you are their legitimate owner.
- If the images depict third parties, you must have their express consent to publish them on Vestigia.
- In the case of deceased persons, authorization corresponds to their heirs or closest family members, in accordance with applicable law.
- Vestigia will remove any image upon receiving a legitimate claim from the represented person or their heirs.
Profile claims
If you find a managed profile that represents you or someone close to you, you can request its claim through the feature available on the platform. The current manager will receive your request and may approve or reject it. In case of a dispute, you can contact Vestigia at info@vestigia.me to act as a mediator. If the claim is not resolved within a reasonable period, Vestigia reserves the right to transfer or remove the profile.
Content removal (Notice and Takedown)
If you believe that any content published on Vestigia violates your rights or those of a third party, you can request its removal by sending an email to info@vestigia.me indicating: your identity, the specific content you wish to have removed, and the reason for the request. We are committed to evaluating and responding to every request within a maximum of 72 business hours.
AI-generated content
Vestigia offers optional artificial intelligence tools to help you write your legacy. When using these tools:
- Generated content is based on your responses and data, but is processed by third-party services (OpenAI). Your data is sent to OpenAI exclusively to generate the requested content.
- You are responsible for reviewing, editing, and approving any generated content before publishing it on your profile.
- Vestigia does not guarantee the accuracy, originality, or suitability of AI-generated content.
- Generated content does not reflect the opinions or positions of Vestigia.
Protection of minors
Vestigia is intended for persons aged 16 and over. We do not knowingly collect or process personal data of persons under 16 years of age. If we detect that a user is under 16, we will proceed to delete their account and all their data. If you are a parent or legal guardian and believe that your child under 16 has registered on Vestigia, contact us at info@vestigia.me so we can proceed with the deletion.
Suspension and cancellation
We reserve the right to suspend or cancel your account if you breach these terms, without prejudice to any legal actions that may apply. You can cancel your account at any time from your profile settings.
Limitation of liability
Vestigia is provided "as is", without warranties of any kind. We are not responsible for:
- Temporary service interruptions due to maintenance or technical causes.
- Loss of data resulting from circumstances beyond our control.
- Indirect damages arising from the use of the platform.
Applicable law
These terms are governed by Spanish law. Any dispute arising from their interpretation or application shall be submitted to the competent courts of the user's domicile, except where the law provides otherwise.
